LABOUR MARKET IMPACT ASSESSMENT
A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker. A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter. If the employer needs an LMIA, they must apply for one. Once an employer gets the LMIA, the worker can apply for a work permit.

TEMPORARY
An LMIA application allows an employer to hire a foreign worker to fulfill a role in their business. A business which is operating for less than one year or can submit a temporary LMIA application to support the employment of a foreign worker.
PERMANENT
An LMIA application allows an employer to hire a foreign worker to fulfill a role in their business. A business which is operating for more than one year can submit an LMIA application to support the employment of a foreign worker and their Permanent Residence. To do so, the business must present the following:

- Provide proof of recruitment attempts, to evidence the attempts made to hire a Canadian citizen/ Permanent Resident.
- Provide documents to prove the legitimacy of the business.
- Provide proof of the business’s ability to pay the Foreign worker their wage.
Once the LMIA is approved, the foreign worker is eligible to apply for a work permit, along with their offer of employment.
OWNER / OPERATOR LMIA
The Owner/Operator stream allows for individuals to invest their money in Canada and operate their business from within Canada. The owner/operator LMIA applications are used to employ an owner in a role within the business. This application is exempt from having to advertise the job to the general masses. To qualify for this type of LMIA application, the requirements an applicant has to meet are as follows:
- Be a sole or majority shareholder in a business.
- Demonstrate that your business in Canada will result in the creation or retention of jobs for Canadian permanent residents / citizens.
INTERNATIONAL MOBILITY PROGRAM
The International Mobility Program allows for business persons to travel into Canada on a work permit under certain Free Trade Agreements. These FTA’s will eliminate the need for eligible persons to require an LMIA. The Free Trade Agreements target individuals working in certain countries whose arrival in Canada would benefit the Canadian economy.
